David has represented clients in claims involving wrongful death and serious injury in a broad range of civil practice, including claims resulting from defective consumer products, motor vehicles and industrial equipment, medical negligence, construction site negligence, motor vehicle accidents, and other complex litigation claims. In addition, he has represented clients in such diverse areas of civil practice as NASD arbitration proceedings relating to the WorldCom corporate scandal. David’s legal writings have been published in Trial magazine.

David joined Sugarman as an associate in 2003 and became a principal of the firm in 2011.

 

Selected Cases

Failure to diagnose pelvic/ovarian abscess,  Settlement against a primary care physician and a for-profit hospital following the death of a 35-year-old mother of two children who died of septic shock as a result of the defendants’ failure to properly initiate antibiotic treatment or administer diagnostic testing.

Failure to diagnose acute coronary episode,  Settlement against a primary care physician following the death of a father of two children who died from myocardial infarction as a result of the defendant’s failure to appreciate the severity and cause of the patient’s complaints and failure to properly interpret the patient’s EKG readings.

Defective elevating scissor lift, Settlement in product liability suit for construction worker who sustained severe crush injuries due to the defective design of a safety device in an elevating scissor lift that allowed the lift to rise due to inadvertent contact with the joystick – the very hazard the safety device was intended to prevent.

Defective airplane cargo loader,  Settlement in product liability suit for a Logan Airport airline worker who sustained crush injuries to his pelvis and hip when the safety rails on a cargo loader failed to activate, allowing a 1,500 lb. pallet to move off the loader and land on the worker after the pallet fell approximately 15 feet. The accident occurred due to a manufacturing defect in an electronic sensor used to activate the safety rails whenever the loader was in operation.

Craneway collapse at Fore River Shipyard,  Settlement for the four young children of a construction worker who was killed when a massive steel craneway collapsed. The general contractor failed to develop an engineering or demolition plan for the dismantling of the craneway and made cuts to the craneway that left a portion of it a free standing structure without securing it or warning any of the workers at the site of the danger posed by the free standing structure.

Couple struck by tractor trailer,  Pre-suit settlement for husband and wife whose van was struck from behind by a tractor trailer. The wife sustained ACL tears in both her knees and the husband developed compartment syndrome resulting in extensive surgeries and scarring. The couple also recovered for the loss of their dog, who was killed in the crash.
